Overview:
As a Senior Counsel on the Financial Services Legal Team, you will apply your strategic and analytical skills to major challenges and significant business initiatives as a member of An American Bank Holding Company's Financial Services (“FS”) Division. An American Bank Holding Companys FS Division is headquartered in Plano, TX, and is a leader and pioneer in the auto finance and technology industries specializing in the delivery of AI, machine learning, and other tech-enabled solutions to dealerships, businesses, and consumers alike.

Specifically, this role will support FS's burgeoning Data Insights team whose application allows its customers to intelligently monitor data using powerful machine learning algorithms designed to detect anomalies in real time, proactively signal critical trend changes, and conduct sophisticated root cause analysis. Additionally, the role will be the primary advisor to other FS technologists, designers, and analysts tasked with strategizing and building innovative solutions to division-wide challenges, as well as supporting the FS marketing team that's central to helping cultivate An American Bank Holding Company's iconic and nationally-recognized brand.

Specific responsibilities include, but are not limited to:
Strategic Advice: Understanding the commercial software industry and auto finance business and the rapidly evolving landscapes for both, fostering innovation through an understanding of the applicable laws, and charting a course for rolling out, marketing, selling, and negotiating agreements for innovative products where no clear roadmap exists. You'll drill down into how we do what we do, and why we do what we do, so we can build a better way.

Translating: Understanding the law (e.g., data privacy, IP, antitrust, TILA/Reg Z, ECOA/Reg B, FCRA/Reg V, UDAAP), understanding the business and the commercial software and auto industries, knowing the technology itself (APIs, AI, OSS, machine learning) and exhibiting an innate desire to learn along with it. You'll appreciate dynamic business intent, regulatory requirements, and legal guardrails and best practices, fluidly transition between legalese and developer speak, and do so comfortably with engineers and senior executives alike.

Business ownership: Working hand-in-hand with the business to solve problems in flight. You'll need an ownership mindset and to view yourself as part of the business team. You don't need to know everything about everything, but you'll have a thirst to understand what you're reading about – a “learning mindset” – that focuses on how to change the world in awesome ways rather than merely reciting statutes and regulations.

Partnering to Foster Innovation: Collaborating closely with colleagues across the Legal Department to fully vet and scale risk. You'll work to push responsible innovation in challenging gray areas. Basic Qualifications:
  • Juris Doctor from an accredited law school
  • Active member in good standing of at least one state bar
  • At least 7 years of experience in a law firm environment or as in-house counsel for a Fortune 500 company as a litigator or advising on regulatory compliance

Preferred Qualifications:
  • 3+ years of experience in advising technology or financial-services companies
  • 3+ years of experience working as an attorney on tech, data, marketing, or product development
  • Technology-savvy and interested with an understanding of cloud technology, open source licensing, machine learning, and AI
  • Experience drafting commercial software license agreements or product terms
  • Knowledgeable about copyright and intellectual property law
  • Experience advising companies on matters of regulatory compliance, including with UDAAP, the FCRA, GLBA, ECOA, and TILA
  • Ability to work effectively both in teams and independently, make effective and integrated decisions, and collaborate effectively at all levels in the company
  • Ability to deal with ambiguous situations, complex concepts, and details
  • Excellent written and oral communication skills with the ability to influence others
  • Strong analytical and problem-solving skills
