Telework Information: This position is eligible for hybrid work schedule, with up to two days of remote work and three days or more onsite, per week.

Are you passionate about making a difference in a fast-paced, collaborative environment? CalPERS is currently seeking an Attorney V to perform complex legal professional work in the Legal Office's Litigation Team, and drive the CalPERS mission.

Duties include but are not limited to:
  • Independently preparing cases by identifying and interviewing witnesses; securing and evaluating evidence; preparing arguments and law and motion. Independently making strategic decisions and substantive recommendations, organizing case presentations, and conducting trials.
  • Representing CalPERS in the initiation of and during difficult and complex administrative and court proceedings. Appearing on behalf of CalPERS at administrative hearings and in court and before other administrative bodies.
  • Preparing agenda items for the administrative cases being heard by the Board of Administration (Board). Arguing staff recommendations on administrative cases when heard on the record by the Board during Full Board Hearings.
  • Monitoring and overseeing litigation in coordination with the Attorney General's Office and outside counsel. Keeps clients informed of the status of all cases and confers with and advises clients of all substantive matters.

The SOQ must be typed, titled “Statement of Qualifications”, and each statement must be numbered and answered listing all relevant experience, education, and training, including places of employment, dates, and duties performed.

The SOQ must not exceed three pages in length and must not have font smaller than 11 point and address the following:
  • Please describe your experience and identify the number of years that you have represented clients in litigation matters before federal, state, administrative, and appellate tribunals involving legal issues including federal securities law, class actions, corporations and corporate governance, pensions and trusts, federal tax, health benefits, employment, open meetings, and public records.
  • Please outline your experience and identify the approximate number of cases that you have reviewed, analyzed, prepared, and presented to a trier of fact in complex civil litigation cases, including in state and federal courts.
  • Please discuss your experience overseeing litigation conducted by outside counsel and the California Attorney General's (AG) Office, as well as your experience coordinating with the AG's Office and U.S. Department of Justice on investigation and litigation matters.
  • Please describe your experience advising executive and senior staff on legal risks facing an organization, litigation strategy and oversight, problem definition, and conflict resolution of complex legal issues.

Desirable Qualifications:
In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
  • Litigation experience including administrative, civil, and class action cases, and experience with state and federal court of appeals.
  • Experience representing governmental agency(ies) before administrative bodies or courts.
  • Experience handling Public Records Act requests, third party subpoenas and discovery requests.
  • Experience in advising public employers re: retirement law including: health, disability, death, and service credit benefits; final compensation calculations; qualification for membership; bankruptcy, collections and overpayments; community property divisions; open meeting act; state contracting law; due process and constitutional law; privacy laws; workers' compensation laws; and statutory interpretation.
  • Experience providing legal review, analysis or advice to public employers on contractual matters.
