Job Description and Duties:
This position receives a $900 monthly differential pay and is eligible for hybrid telework. If employees desire to come into an Employment Advocacy and Prosecution Team (EAPT) office, they may do so at any EAPT location (Sacramento, Bakersfield, or Rancho Cucamonga). EAPT utilizes a hotel-method for office use.

The Department will provide a laptop and cell phone.

This position will support the investigations by the Office of Internal Affairs and the disciplinary process for cases arising out of the California Department of Corrections and Rehabilitation (A Government Entity) institutions and programs throughout California.

The Office of Legal Affairs (OLA), EAPT assists in investigations into employee misconduct, advises on disciplinary decisions, and pursues disciplinary actions on behalf of A Government Entity. In addition, EAPT litigates requests to file charges with the State Personnel Board (SPB), appeals to the SPB, or whistleblower complaints before the SPB, and defends or prosecutes petitions for writs of administrative mandamus before the superior and appellate courts. EAPT works with highly sensitive and confidential information and requires employees to maintain strict confidentiality.

This position is distinguished from other Attorney positions by the expertise, training, and education required to perform the duties. Under the general direction of the Chief Deputy General Counsel (CDGC), Assistant CDGC, or Assistant Chief Counsel, the EAPT Attorney IV (Vertical Advocate) effectively performs, with a high degree of independence, the most difficult, complex and sensitive legal work on the team, in particular characterized by assignments applying sound investigative principles to high level investigations involving allegations of misconduct within A Government Entity.

A Government Entity Headquarters has implemented a new automated system to streamline the hiring process. The Human Resources Technology System (HRTS) is an intuitive, user-friendly system that provides the applicant access to real-time updates throughout the hiring process. Working Conditions:
EAPT offices are located in Sacramento, Bakersfield, and Rancho Cucamonga. This position is eligible for a hybrid telework schedule for employees who can satisfactorily perform their essential work functions independently and remotely. Specific telework schedules may be discussed further during the interview process. On occasion, travel may be necessary to a A Government Entity institution or location throughout the state for site inspections or interviews, SPB appearances, and court appearances. Days of work may include any day of the week, and hours may include non-standard business hours. Telework is only available to residents of California.

Special Requirements:
The position(s) require(s) a(n) California State Bar Membership License. You will be required to provide a copy of your license prior to being hired.

Candidates new to A Government Entity or the Division of Juvenile Justice are required to submit to a background investigation process utilizing Live Scan Fingerprinting, and Tuberculosis testing prior to appointment followed by department annual Tuberculosis testing/evaluation thereafter.

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
  • Significant experience with trials or evidentiary hearings in state or federal court or before administrative agencies
  • Experience with writs or appeals to the Superior Court or to Courts of Appeal
  • Experience leading or mentoring attorneys
  • Experience managing complex and sensitive projects or cases
  • Experience collaborating in a team environment with internal and external stakeholders, and working with oversight agencies
  • Willingness to create and promote an equitable and inclusive workplace where diversity is celebrated and valued
