Sr. Counsel Litigation will serve as the Company's litigation counsel providing advice and guidance to management on a wide variety of litigation issues which arise from the day-to-day operations of a growing, complex public company. The assignments and responsibilities require direct contact with internal and external clients, the ability to handle complex legal issues, the ability to work independently, critical judgment, and the ability to identify and minimize potential legal exposure and risk.

This position has been segmented as Hybrid meaning there is a combination of three onsite days per week and the rest remote.

Responsibilities:
  • Collaborate with and provides direction to Associate General Counsel on litigation matters and significant pre-litigation claims.
  • Provide guidance to the Company and management team, on litigation matters and significant pre-litigation claims, including all policies and procedures.
  • Familiarity with Company policies including supply chain safety-related policies and training materials, and third-party vendor and indirect procurement relationships; advise on updates as appropriate.
  • Provide senior management and business units with advice, counseling and advocacy regarding litigation risks and mitigation efforts while business objectives.
  • Keep the Company's management abreast of significant litigation, legislation and regulatory rulings that may affect the Company's business or policy.
  • Participate in antitrust prosecution practice through direct action suits as well as managing and identifying recovery opportunities.
  • Manage commercial, automobile liability and general liability litigation by gathering facts from internal clients to broaden or narrow scope of questions based on information received or subject matter of inquiry while cost management to ensure effective use of resources.
  • Participate in management of established national outside counsel relationships.
  • Coordinate with the finance department and prepare reporting for the Company's auditors in connection with regulatory disclosures.
  • Develop a thorough understanding of and familiarity with the Company's business, its people, markets, facilities, customers, and competitors in order to identify trends and formulate appropriate structures and strategies.
  • Establish a rapport and working relationship with teammates at all levels in order to encourage and continue the proactive use of in-house legal counsel.
  • Perform special assignments or projects as assigned by the Associate General Counsel and General Counsel

Relationships:
Internal: Advises, counsels, acts as a key partner for internal business stakeholders.

External: Works with outside counsel retained by An American Food service Distributor Company, An American Food service Distributor Company third-party administrator, insurance carriers, experts, customers, government agencies and other key third-party vendors.

Minimum Qualifications:
  • Minimum seven (7) years related litigation experience
  • Prior in-house counsel experience strongly preferred

Licenses:
J.D. required (licensed to practice in Illinois)

Preferred Qualifications:
  • Able to manage multiple projects and work successfully in a fast-paced environment under time constraints.
  • Excellent interpersonal skills, with an ability to inspire trust and confidence with stakeholders at all levels.
  • Strong written and verbal communication skills, including the ability to clearly and concisely articulate complex legal concepts to a lay audience.
  • Proven ability to evaluate issues incisively and pragmatically, and independently make decisions regarding complex legal issues with minimal supervision.
  • Skilled in interactions which involve contentious situations and garnering support for issues or projects.
  • Working knowledge of transportation litigation, premises liability, product claims, and complex commercial disputes.

Education:
  • Juris Doctor from an ABA-accredited law school.
  • Licensed to practice law and in good standing under the Bar of any state that enables admission to practice as in-house counsel.
