About the role:
Location: The location for this position will be based out of East Hanover, NJ or Manhattan, NY and follow a hybrid working model.

The Senior Privacy Counsel US provides strategic and operational legal advice to the Data Privacy, Digital & AI Function (DPDAI) (part of A Swiss Multinational Pharmaceutical Company Based in Basel, Switzerland Ethics, Risk and Compliance Function), General Legal, and the Business on data privacy, data protection and related laws and regulations and data privacy incidents in the US.

Your Key Responsibilities:
  • Ensure close working relationship with DPDAI, General Legal as well as alignment within the global Data Privacy Legal team.
  • Monitoring laws and regulatory guidance in the US and provide legal advice to DPDAI on how to integrate the US data privacy and data protection legal requirements into the A Swiss Multinational Pharmaceutical Company Based in Basel, Switzerland Data Privacy Program (“data privacy by design”).
  • Provide legal advice to DPDAI and General Legal (and, as needed and in co-ordination with DPDAI, to the Business) in relevant global / regional / local projects, including privacy contracting strategy and negotiations.
  • Manage outside counsel on privacy and data protection legal issues as needed.
  • Train DPDAI, General Legal and other relevant stakeholders on privacy data protection laws and regulatory guidance in the US.
  • Provide legal advice to the Head Data Privacy Legal Americas and the Global Head Data Privacy Legal, to IT Security, and other relevant stakeholders on data protection matters in the US, including the qualification and handling of data privacy incidents.
  • In close coordination with the Head Data Privacy Legal Americas interact with regulators in the US, work with A Swiss Multinational Pharmaceutical Company Based in Basel, Switzerland Public Affairs to influence policy/legislation, including within trade associations, and update the Head Data Privacy Legal Americas, the Global Head Data Privacy Legal and senior management on data privacy, data protection, Artificial Intelligence, and related legal developments in the US.
  • Establish and leverage strong contacts with data privacy legal professionals at other companies.

Role Requirements
  • Legal degree and admission to the bar (NY, NJ, or NJ In-house preferred)
  • Lawyer with proven track record of successfully managing complex legal issues in multi-disciplinary and international setting
  • A minimum of 7 years of experience in a multinational company, ideally in the healthcare sector, or a global law firm.
  • Deep expertise in data privacy and data protection legal matters, demonstrated ability to rapidly acquire and master expertise in new legal areas.
  • Experience in “legal crisis management”
