A Government Entity, Legal and Regulatory Services has a full time vacancy for Bureau of Mental Health Services Attorney.

Summary:
Administers and coordinates the legal activities of the Bureau of Mental Health Services. Provides additional general counsel services, legal analysis and representation within the Department. Works under the general direction and supervision of the Director of Client and Legal Services, Legal & Regulatory Services.

Responsibilities:
  • Interprets laws and court decisions to provide legal advice primarily to the Bureau of Mental Health and legal information to consumers of mental health services and their family members and to service providers. Plans and conducts legal research on topics related to the administration of services.
  • Supervises the client rights protection and appeals process and conducts investigations and reviews of alleged rights violations to determine the validity of such allegations and drafts recommended decisions and dispositions for such cases. Supervises complaint investigators who are under contract to the Department.
  • Supervises rulemaking process for the Bureau of Mental Health Services.
  • Plans, conducts and evaluates educational efforts directed to consumers, family members, service providers, attorneys and judges, and the public to enhance understanding of the rights of clients of the mental health services system.
  • Files petitions pursuant to RSA 171-B seeking commitment of persons who have been found incompetent to stand trial due to an intellectual disability.
  • Drafts guardianship petitions for individuals residing at New Hampshire Hospital and Glencliff Home for the Elderly and represents the state at hearings on these petitions in the various probate courts statewide.
  • Conducts meetings between employees and supervisors to resolve personnel disputes.
  • Manages contracts with public guardianship agencies and attorneys representing individuals subject to Involuntary Emergency Admission.
  • Supervises the execution and approval of contracts with Bureau of Mental Health Service providers and other legal documents.

Minimum Qualifications:
  • Education: J.D. from an American Bar Association recognized law school.
  • Experience: Four years' experience in active practice of law.
  • License/Certification: Valid driver's license and/or access to transportation for statewide travel.

Special Requirements: Must be a member of the New Hampshire Bar Association and in Good Standing.
