Purpose and Scope:
Under the general direction of senior attorneys, the Assistant General Counsel will provide legal support on a broad range of corporate and healthcare matters, with a particular focus on contracting and healthcare regulatory work. This individual will be part of Kidney Dialysis Centers inclusive and collegial Law Department, which is comprised of lawyers and additional professionals working on cutting-edge legal issues across several practice groups, including Corporate, Litigation, Payor Relations, Regulatory, and Specialty Services, in support of Kidney Dialysis Centers wide range of businesses.

Principal Duties and Responsibilities:
  • Provides legal advice and support concerning all aspects of healthcare law, with particular emphasis on regulatory compliance and contract review and negotiation.
  • Drafts, reviews, revises, and negotiates legal agreements and documents. Confers with senior attorneys on complex matters as needed.
  • Provides advice, conducts research, and/or investigates, as applicable, in all areas of healthcare law, including, but not limited to:
    • Fraud and abuse, Stark, and general healthcare-related legal issues.
    • Medical director contracting and non-compete analysis.
    • Health facility planning, certificate of need, and licensure.
    • Medicare certification and de-certification.
    • Joint ventures.
    • Antitrust.
    • Medical Staff matters, including credentialing/privileges, advanced practitioners, and disciplinary actions.
    • Patient-related issues, including advance directives and medical decision-making.
  • Participates in the resolution of a wide range of business, contractual, financial, and operational issues relating to healthcare operations and healthcare reimbursement.
  • Works toward innovative solutions to meet business objectives while ensuring regulatory compliance and mitigating business and legal risk.
  • Collaborates with various corporate departments, including compliance, clinical, medical, risk management, and human resources to resolve multi-faceted issues.
  • Assists litigation counsel with potential and pre-litigation matters.
  • Provides advice to and conducts research for senior attorneys as requested.
  • Assists with various projects as assigned.
  • Other duties as assigned.

Education:
  • Juris Doctorate from an accredited college or university required.
  • License to practice law in at least one state required.

Experience and Required Skills:
  • 4 or more years of experience as a practicing attorney with experience in corporate, transactional, and/or healthcare regulatory matters.
  • Experience drafting, negotiating, and interpreting contracts required; experience providing real-time guidance to business colleagues strongly preferred.
  • Ability to work independently and to manage numerous complex legal issues simultaneously with minimal supervision.
  • Strong commitment to customer service.
  • Ability to provide sound, practical legal advice to business colleagues.
  • Excellent legal research skills.
  • Strong oral and written communication skills, including the ability to communicate effectively with all levels of corporate operations teams, from direct care providers to upper management, as well as with Law Department colleagues, outside counsel, and other corporate teams such as compliance, regulatory, and clinical services.
  • Demonstrated presentation skills.
  • Proficient with PCs, Microsoft Office applications and case management databases.
