Purpose of Position:
The Employment and Labor Law attorney assists the General Counsel, Chief of Human Resources and Director of Employee Relations in the management and handling of labor and employment related matters. The attorney will represent the district in employment related matters, including advising on the terms of the various collective bargaining agreements, assisting the Director of Employee Relations on labor grievances, personnel issues, and contract negotiations.

Essential Duties and Responsibilities:
  • Provides in-house legal counsel on labor and employment related matters, which may include, but are not limited to wage and hour laws, workers’ compensation, unemployment, Americans with Disabilities Act, Family Medical Leave Act, and other state agency claims; general labor relation matters, employee benefits, employment agreements and policy related issues, employment-related litigation, grievances and arbitrations.
  • Represents the District at Wisconsin Employment Relations Commission mediations and hearings for prohibited practice complaints, unit clarifications and interest arbitration.
  • Represents the District in Board of Education non-renewal hearings, discharge and disciplinary matters
  • Represents the District in court for labor and employment-related matters, including, but not limited to injunctions, temporary restraining orders, and agency appeals.
  • Acts as the legal representative in the handbook review process.
  • Researches, investigates and settles grievances, and prepares for grievance hearings.
  • Acts as a strategic business partner to the human resource department to implement policies and practices supporting compliance with applicable laws and regulations.
  • Assists General Counsel in responding to labor -related administrative and legal matters, including, but not limited to equal employment opportunity, civil rights complaints, Title IX, Title VII, Wisconsin Statute 118.113, and City of Madison Chapter 39.03.
  • Refers complaints to the Title IX Coordinator.
  • Maintains knowledge of current labor law, labor contract negotiation techniques, district personnel policies and procedures and negotiates labor contracts.
  • Consult with the human resources department on handbook interpretation, performance management, staffing, disciplinary matters, accommodations under the Americans with Disabilities Act including Service Animals, and mediation services.
  • Advises Human Resources staff in evaluating requests for accommodation under the Americans with Disabilities Act.
  • Be familiar with and advise employees on the employee bullying complaint process.
  • Identifies and assesses legal risks and opportunities within the labor and employment area and advises accordingly.
  • Performing other tasks as assigned by General Counsel & Chief of Human Resources.
