You will embrace and support these efforts by providing practical labor & employment advice to business clients and by pursuing and defending labor & employment claims through negotiation, arbitration or litigation. You will also work closely with Guaranteed Rate’s Human Resources department to accomplish the Company’s workplace objectives. You will be expected to work independently, solve problems creatively, prioritize tasks and matters, exercise business judgment, and operate with a sense of urgency to get things done. You will work closely with Company leadership, support all levels of management and will be expected to provide day-to-day advice on a variety of labor & employment matters.
Support and counsel HR on federal and state labor and employment issues, including without limitation wage & hour, leave of absence and accommodations, employee classification, alleged retaliation, whistleblower issues, and employee benefits.
Provide legal, strategic, and business guidance to HR with respect to recruiting/talent acquisition, voluntary and involuntary terminations, internal investigations, compensation and rewards, and learning and development.
Support HR with draft employment and separation agreements.
Review and update employment policies, including the Company’s employee handbook, and implement procedures and other controls to ensure compliance with the Company’s policies and applicable laws.
Counsel HR and Company management on relevant changes in the law, including state and local laws and regulations that impact operations.
Represent the Company before state and federal agencies and in arbitrations and other legal proceedings.
Draft and respond to cease and desist letters and demand letters.
Negotiate and resolve pre-litigation disputes.
Engage and manage outside counsel for required expertise and more complex employment litigation matters.
Handle other legal matters as assigned by management.
At least 6 years of labor and employment experience, including labor and employment counseling and litigation.
Excellent working knowledge of federal and state employment laws and regulations (including ADA, ADEA, FLSA, FMLA, Title VII of the Civil Rights Act of 1964, etc.).
Excellent grasp of emerging state-law trends including with respect to “ban the box” and fair hiring laws, equal pay legislation, laws targeting arbitration agreements, etc.
Experience litigating restrictive covenant matters will be a significant advantage.
Prior financial services or real estate industry experience, especially mortgage transactions and regulatory experience, will also be a significant advantage.
