Senior Counsel responsible for providing comprehensive employment law support for Human Resources (HR) (including Talent, Compensation, Global Total Rewards, and Global Mobility) and business professionals across North American operations and activities of a global biopharmaceutical business.
Provide informed, actionable legal support and strategic counsel for the Human Resources and business professionals across CSL Behring (including its affiliates, CSL Plasma, Seqirus and Calimmune) in North America (including Canada):
Support North American HR and business professionals by providing day-to-day employment law advice on a variety of topics, including FMLA, ADA, discrimination, counseling, discipline, documentation, terminations, investigations, wage & hour, collective bargaining, compensation and other matters
Advise HR team in development, review and regular updates of HR policies, work instructions and standard operating procedures
Monitor and update HR and Legal on relevant federal, state and local employment law developments
Identify and work with HR to remediate any problematic or non-compliant employment practices from recruitment through termination across CSL Behring and affiliates throughout North America, with an eye toward minimizing risk
Provide in-person and remote training to HR and business professionals as requested
Review/approve severance agreements
Manage triage, investigation and closure of all North America HR-related Compliance Hotline calls
Provide Legal approval of contingent worker engagements/extensions, consistent with applicable policy requirements, as requested
Oversee, with outside counsel, annual Affirmative Action Plan development for all North American businesses
Investigate and respond to demand letters from counsel for current/former employees
Manage litigation hold process, in conjunction with Global Legal Operations & Services
As requested or assigned, work with counsel in CSL affiliates to ensure delivery of consistent employment law-related support across businesses
Oversee outside counsel in federal and state litigation, and in response to federal, state and local agency discrimination charges, including preparation and approval of position statements
Oversee company response to federal and state agency investigations (e.g., DOL wage/hour audits)
Collaborate with HR and Labor Relations regarding management of unionized manufacturing workforce
Support Lead Counsel, Global Employment Law regarding international employment law matters as requested
Bachelor’s degree and Juris Doctor degree. Superior academic credentials at a law school strongly preferred.
Must be licensed to practice law, with active bar membership in at least one U.S. state.
Minimum of 7 years applicable legal experience with focus on employment law required, preferably including at least 3 years supporting employers in the pharmaceutical industry, either as in-house or external counsel.
Qualified candidate will have significant experience (i) independently counseling clients (particularly HR) on universe of employment law-related matters, and (ii) litigating in and appearing before federal and state courts and agencies.
