The Department of Health seeks an Attorney for the USDA Child Care Food Program in the Office of General Counsel. The incumbent of this position will spend 67% of time providing service delivery activities that include contractor monitoring and review, technical assistance, and contractor service delivery quality control for the USDA Child Care Food Program administered by the Bureau of Child Care Food Programs and 33% of time serving as legal counsel for the Special Supplemental Nutrition Program for Woman, Infants, and Children (WIC). The incumbent in this position will be required to complete a certification twice a year stating that all time worked has been on the Child Care Food Program. The incumbent in this position will receive supervision and direction from the Chief Legal Counsel of the Litigation Practice Group.

Serves as counsel for the Division of Community Health Promotion. Responds to oral and written requests for legal opinions involving the Division. The legal opinions specifically address and answer the questions raised and are based on careful research, a discussion with the person requesting the opinion and other persons having relevant information, and an exploration of underlying relevant facts.

Identify potential legal problems involving planning, operations and administration of programs and responsibilities under the Division. Present identified problems within proposed legal advice to department managers and the General Counsel.

Represents the Department in litigation involving the Division in all forums. These forums include, but are not limited to (a) state trial and appellate courts, (b) federal trial and appellate courts, and (c) state and federal administrative forums. In the course of litigation, maintains contact with department personnel affected by the suit, informing them at all major decision points, and providing copies with all substantive pleadings and memoranda filed and received. Thoroughly research the facts and law for each case and communicate this to department personnel and the Office of the General Counsel. During the course of litigation, the ultimate goal is to facilitate the department's mission to protect public health through programs assigned to the Division.

Work with personnel in the Division in developing legislation, reviewing proposed legislation from any source, implementing new legislation, and reviewing existing statutes for the purpose of proposing any needed remedial legislation. Review proposed rules of the Division for both substantive and technical legality and advise the Chief Legal Counsel, Deputy General Counsel and/or General Counsel on the content of such rules to assist in the review and approval process. Participate in rule development, rule workshops and rule hearings.

Review the Division contracts, requests for proposals, and contract related documents for legal compliance. Participate in contract negotiations, arbitration and dispute resolution.

The incumbent answers general inquiries as fully as possible in a tactful and courteous manner. To the extent not handled by the agency clerk, prepares final orders.

Performs other duties and responsibilities as assigned or required by the Office of the General Counsel. Participates in and attends educational conferences and other opportunities to enhance personal and professional growth and development. Operates within the Litigation Practice Group. Accepts assignments as required from the Litigation Group Leader.
This occupation requires membership in the Florida Bar.
