Responsible for monitoring and researching regulatory compliance issues, as directed, relating to insurance operations for the National Indemnity group of insurance companies, and preparing summary analysis, drafting documents and making recommendations to the Regulatory Compliance Counsel and senior management. Conducts policy auditing for compliance purposes. Creates drafts of company policies regarding legal compliance. Conducts legal compliance audits for non-primary group operations of the National Indemnity group of insurance companies. Assists management when communicating with regulatory compliance areas of other Berkshire Hathaway insurance companies and serves as a liaison with state insurance departments.
Major Duties:
Researches compliance issues, as directed, pertaining to the insurance operations of the National Indemnity group of insurance companies. Evaluates the legal issues concerning coverage and procedures for underwriting, pricing, and other business processes. Audits other compliance-related activity for these operations. Summarizes and recommends to Regulatory Compliance Counsel and senior management actions to be taken as a result of the review of the materials.
Analyzes and understands insurance coverage and policy forms used to create Company insurance policies. Drafts proposed policy language. Participates in the revisions to coverage forms. Provides copies to upper level Company management and Regulatory Compliance Counsel for input and final approval.
Analyzes and understands current underwriting procedures. Assists Company personnel with the procedures. Participates in making changes to the procedures made to comply with new laws or as directed by management. Assists Regulatory Compliance Counsel with summarizing and recommending to senior management actions to be taken as a result of the review of the materials.
Helps implement changes to Company software made for compliance issues, including testing. Provides direction to programmers on how software will implement underwriting procedural changes. Assists the Company with maintaining computer network and electronic and data security compliance requirements.
Maintains legal databases and policy construction guidelines. Assists with company policy documentation maintenance. Directs changes to these databases and guides as necessary. Notifies agents and Company personnel of form and procedure changes, including written instructions for implementing the changes.
Conducts compliance survey and audit work of the non-primary National Indemnity group of insurance companies' operations. Summarizes conclusions for Regulatory Compliance Counsel. Gives conclusions and recommendations to outside operations.
Participates in creation of company policies relating to compliance issues.
Assists with market conduct exams and similar state insurance department inquiries by answering questions and discussing issues.
Directs others in filing agreed coverage forms with state insurance departments. Serves as liaison with state insurance departments to answer questions and discuss issues regarding forms and procedures.
Communicates with other Berkshire Hathaway insurance operations as necessary to share regulatory compliance knowledge, compare compliance approaches, and help with contract and legal review.
Trains Company personnel on compliance issues, coverage forms, Company software, and filing procedures.
Performs other duties as directed or as situation dictates such as reporting NICO group of companies’ fines or violations of state statutes to state insurance departments and participating in the Agency workshops.
Knowledge, Skills, and Abilities: (*minimum qualifications needed to perform essential job function)
Required Knowledge:
Bachelor degree or equivalent work experience
Juris Doctorate Degree
2-3 years related work experience
Legal research methods
Insurance coverage and insurance products
Preferred Knowledge:
Familiarity with Westlaw
Company, agency and department practices and procedures
