Position Overview
The Real Estate Counsel will be a member of the in-house legal group that supports the development team during the company’s expansion and growth. The Real Estate Counsel is responsible for providing real estate legal expertise in the acquisition, development, financing and sale of solar energy projects. The Real Estate Counsel will be a part of a dynamic, collaborative team and work closely with other departments within the company (project development, permitting, engineering, construction and finance). This position reports to the General Counsel or another senior management personnel that the President of the Company may designate. This position is expected to travel up to 10%. We are looking for a seasoned professional with experience in the following:

  • Draft and negotiate real estate-related development agreements, such as options, leases, purchase agreements, easements, crossing agreements, non-disturbance agreements and surface waivers;
  • Conduct broad range of real-estate related project due diligence, including reviewing ALTA surveys and title reports and obtaining title insurance policies and endorsements;
  • Interface with outside consultants, such as surveyors and title companies;
  • Provide legal support and analysis on project development-related issues;
  • Coordinate efforts with other internal teams to propose appropriate risk management, identify critical project risk issues and make recommendations and provide summation of documents for execution; and
  • All other duties, as assigned by the General Counsel.

Required Qualifications
  • Juris Doctor degree from an accredited law program with minimum of 5 years of experience
  • Minimum of 3 years of significant real estate experience in project development, particularly in title review and surveys
  • Experience in construction, development, clean or renewable energy is preferred
  • Willingness to travel, up to 10%
  • Must be a strong team player
  • High degree of professionalism and conduct at all times
  • Excellent organizational and verbal and written communication skills
  • Ability to multi-task, set priorities, meet deadlines
  • Excellent academic and work credentials are required
