Leasing Attorney

Position Summary
The leasing attorney is responsible for negotiating, drafting and reviewing commercial leases and other related real estate agreements (i.e. option notices, kickout notices, renewal amendments, estoppels, subordination and non-disturbance agreements, termination agreements, office leases, etc.). The attorney will work closely with outside counsel and manage project workflow or provide guidance as needed. The attorney will support the Real Estate Department and Store Design and Construction Department for projects related to real estate and leasing activities for Bath & Body Works. The attorney will focus primarily on domestic real estate activities and projects, however, may be leveraged to support international activities as well based on demand.

  • Key responsibilities and areas of focus include, but are not limited to:
  • Draft and negotiate complex retail leases and supporting documentation, including assistance in dispute resolution
  • Lead efforts in supporting the internal Real Estate Department and Store Design and Construction Department with regard to all facets of commercial leasing.
  • Lead negotiations that are business critical, complex and/or time sensitive in nature
  • Operate through a lens of risk mitigation with respect to legal issues, commercial business terms, property administration and services while supporting business goals and imperatives
  • Review existing leases to provide counsel on rights and obligations while also meeting critical timelines
  • Partner with Deal Makers, Brokers, Lawyers, Landlords, Store Planning, Accounting and Finance to expedite the deal process
  • Manage a leasing/real estate portfolio while also assisting in a wide variety of projects, including acquisition and disposition matters, corporate contract matters, and general organizational projects as assigned
  • Engage and manage projects and initiatives via external counsel
  • Provide guidance, interpretation and development to a supporting team of paralegals, junior attorneys and/or outside counsel
  • Demonstrate the ability to update contract templates, terms and conditions as necessary to drive efficiency on behalf of the organization

Education and Experience
  • Juris Doctor degree from an accredited law school required
  • Must be a member of the Ohio bar or a licensed attorney who will obtain Ohio bar membership
  • 5-10 years of experience with a law firm and/or in-house counsel in the field of commercial real estate and leasing, preferably in a retail setting
  • Proven experience in leasing, drafting and negotiating retail leases, subleases, amendments and termination agreements
  • Experience with international real estate and leasing desirable
  • Proven experience in handling and managing real estate litigation
  • Demonstrated ability to lead, advise and develop a team
  • Proficient in Microsoft Office suite including Outlook, Word, PowerPoint, Excel and Access
