Description:
The Fair Hearings & Compliance Unit (FHCU) is a litigation and compliance unit reporting to the ACS General Counsel. FHCU, under the supervision of the Associate General Counsel/Supervising Attorney, represents ACS before the NYS Office of Children and Family Services/Bureau of Special Hearings (OCFS/BSH) in the following types of Administrative hearings and Reviews: expungements, adoption subsidy and kinship guardianship. FHCU also represents ACS before the NYS Office of Temporary Disabilities and Assistance and handles Article 78 Proceedings (CPLR) in NYS Supreme Court in which appellants seek to challenge administrative fair hearing decisions unfavorable to them.

The Assistant General Counsel/Assistant Supervising Attorney is to assist in the management and the overall functioning of FHCU and supervision of unit staff representing the Commissioner in all stages of administrative litigation and compliance before OCFS and OTDA and other related proceedings. The Assistant General Counsel/Assistant Supervising Attorney must work closely with the Supervising Attorney and Program Director to develop and maintain unit business procedures and best practices. Responsibilities include but are not limited to:
  • Assist the Supervising Attorney and FHCU Program Director with supervision and administration of the unit.
  • Maintain a personal caseload of 20-40 trial cases.
  • Supervise FHCU attorneys and staff in the litigation of cases before the NYS OCFS and/or OTDA at all stages from Intake/discovery and trial through and including compliance with fair hearing decisions and/or Article 78 appeals to ensure that caseloads are handled appropriately and professionally, including on-site supervision of attorneys and other staff as appropriate;
  • Provide legal analysis, guidance, and advice, as needed, at all stages of litigation through appeal;
  • Collaborate with counsel and program staff from ACS and/or City agencies, NYS agencies, and other outside entities as needed to assist in handling legal questions and responses,
  • Review and advise on proposed legislation and other policy matters, as requested.
  • Other responsibilities and legal work as assigned , including but not limited to production of statistics and reports related to unit staff/caseload/function and participation in trainings and/or workgroups as needed to effectively and efficiently run FHCU and/or further the mission and goals of ACS.

Minimum Qual Requirements:
  • Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.
  • Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.

Preferred Skills:
Familiarity with Family Court Article X and general child protective practice, including complex trial experience; Strong oral and written communication skills Proven ability to establish and maintain effective and congenial working relationships with a wide range of governmental and external entities. Effective and creative leadership ability with the capacity to work both independently and cooperatively to implement key strategies, evaluate new policies, and analyze legal issues.
