Description:
Summary: Under limited supervision, assists the City Attorney in managing the legal affairs of the City, advising the City Council, the City Manager and all other department heads.

Supervision Received: Receives supervision and direction from the City Attorney.

Supervision Excercised: Limited supervision over professional and clerical staff within the legal department as directed.

Essential Duties And Responsibilities:

  • May act as the City Attorney in the absence of the City Attorney
  • Provides legal counsel and advice on various municipal areas including public safety, utilities, land use, planning & zoning, building inspection, transportation, human resources, collective bargaining, property management, public meetings, public records, ethics, and other general government issues
  • May attend various board, commission, and City Council meetings to advice on legal matters
  • Answers communications from the public relative to legal matters affecting the City
  • Drafts and interprets municipal codes and ordinances
  • Appears on behalf of the City before city, county, state, and federal courts in both criminal and civil proceedings
  • Works with legal specialists engaged by the City for the preparation and trial of complex cases the City may be involved in
  • Investigates claims by or against the City
  • Prepares legal opinions, court papers, contracts, ordinances, resolutions, deeds, leases, and other legal documents
  • Prepares reports to City Council regarding pending issues, claims and litigation
  • Represents the City’s interests before individuals, groups, and agencies
  • Assists in the preparation of the legal department budgets
  • Provides direct supervision in work activities within the civil and criminal division
  • Analyzes narrative and statistical data to make recommendations regarding legal issues affecting the City
  • Oversees the enforcement of City policies and procedures, and the maintenance of proper records
  • Supports the relationship between the City of Nogales and the general public
  • Performs other duties as required or assigned

Knowledge Of:
  • City policies and procedures
  • Municipal, State and Federal court systems
  • Criminal Rules of Procedure (State/Federal)
  • Civil Rules of Procedure (State/Federal)

  • Using initiative, discretion and judgment within established procedures, guidelines and rules

Minimum Qualifications:
Education, Training and Experience:
  • Juris Doctorate from an accredited law school
  • Member in good standing in the State Bar of Arizona

Preferred Qualification(S):
  • Court litigation experience
  • Spanish language fluency
  • Judicial clerkship

License And Certification Requirements:
State Bar of Arizona license
