A Non-Profit Membership Organization seeks a full-time attorney in our Environmental Health Program to work on ending anthropogenic air pollution with a focus on fossil fuels issues. For this position, we will consider applicants at both the staff attorney and senior attorney levels. This position is located in Denver, Colorado, Portland, Oregon, Oakland, California or other locations considered on a case-by-case basis.

General position overview:
A Non-Profit Membership Organization works to secure a future for animals and plants hovering on the brink of extinction, for the ecosystems they need to survive, and for a healthy, livable future for all of us. The Center’s Environmental Health Program works to protect all life from pollution, recognizing that the health and vigor of all species, including humans, are inextricably intertwined, The Program’s work focuses on stopping toxic threats and pursing justice from air pollution, pesticides, industrial animal agriculture, water pollution, mining, and countless other threats. We use science, policy, campaign building, administrative advocacy and litigation to fight toxic pollutants. We are looking to add an attorney to advance our air pollution work. We will consider seasoned attorneys as well as those with less experience but a demonstrated commitment to the effort. Examples of our air pollution work include many Clean Air Act enforcement suits to improve implementation of the Act for areas across the country, challenges to national Clean Air Act rulemaking in the D.C. Circuit for failure to comply with Endangered Species Act consultation requirements, state court challenges to air permits, federal court enforcement actions for violations of permit limits, state rulemaking proceedings, and state and federal legislative and referendum efforts. The new attorney will work on litigation, administrative and policy advocacy, and grassroots and media outreach.

Main duties:
  • Administrative advocacy including commenting on proposed permits, rulemakings, and the preparation of petitions for rulemaking.
  • Litigate cutting-edge cases under the Clean Air Act, Endangered Species Act, and other statutes in federal and state court and administrative tribunals such as the US EPA’s Environmental Appeals Board.
  • Analysis of and advocacy regarding pending federal executive and legislative proposals.
  • Preparation of communications such as press releases, op-eds, fact sheets, and white papers, and responding to inquiries and interview requests from journalists.
  • Working closely with others, particularly other NGOs, including affected communities, co-plaintiffs, and coalition partners

Essential qualities, qualifications and skills:
  • Licensed to practice law in the state in which the attorney will be based.
  • Minimum of one year of civil litigation experience or a judicial clerkship for a staff attorney position or eight years of civil litigation experience for a senior attorney position.
  • Excellent legal research, writing and oral advocacy skills.
  • Demonstrated ability to manage a heavy litigation docket, and for a senior attorney position, experience as lead attorney on cases.
  • Demonstrated ability to work effectively with a diverse array colleagues and organizations with a wide array of goals, perspectives, and backgrounds.
  • Commitment to, and ideally experience with, working within an environmental justice framework.
  • Ability to supervise and mentor legal fellows and clerks.
  • A demonstrated ability to work both independently and with a team.
  • A demonstrated ability to take initiative and think creatively about litigation, policy and strategic campaigning.
  • Willingness to occasionally travel, when safe, at times on short notice.

Preferred qualifications, skills, and qualities:
  • Experience with environmental statutes, especially the Clean Air Act, and/or Endangered Species Act.
  • Familiarity with the science of air pollution and the engineering of fossil fuel facilities.
  • Experience with media outreach and interviews.

Salary Range: Staff Attorney $52,000-$75,000 DOE; Senior Attorney: $75,000-$100,000 DOE.
