Duties and Responsibilities: Responsible for the management and supervision of a regional Public Defender Office including the day to day management, administrative and legal work involving the planning, direction, and supervision of staff and contracts in the preparation and litigation of the defense of criminal and civil cases involving public defense. Manage and supervise all public defender services provided within the deputy public defender's assigned region; establish protocols so that when a court orders the office to assign counsel, the assignment is made promptly to an appropriate public defender and so that a public defender is immediately available when necessary; ensure that public defender assignments within the region comply with the provisions of MCA 47-1-202(1) (f) ; which establishes procedures for managing caseloads and assigning cases in a manner that ensures that public defenders are assigned cases according to experience, training, and manageable caseloads and taking into account case complexity, the severity of charges and potential punishments, and the legal skills required to provide effective assistance of counsel; hire and supervise the work of regional office personnel as authorized; contract for services as provided in MCA 47-1-216 and authorized by the chief public defender according to the strategic plan approved by the commission; keep a record of public defender and associated services and expenses in the region and submit the records to the chief public defender as requested; implement the standards and procedures established by the commission and chief public defender for the region; maintain a client caseload as determined by the chief public defender; and perform all other duties as assigned by the chief public defender.

The successful candidate shall:

  • Possess strong interpersonal and communication skills
  • Have knowledge and experience in public administration, public relations, government organization, lobbying, state budgeting, and legislative processes
  • Possess an ability and willingness to establish and maintain effective working relationships with the public, elected officials, defendants, witnesses, judges, court personnel, and law enforcement
  • Possess analytical and problem solving skills
  • Be able to energize and lead the statewide Public Defender System
  • Actively demonstrate a commitment to the state and the mission of Public Defender system
  • Be able to build trust and credibility in working relationships
  • Have extensive knowledge of the Public Defender arena
  • Possess knowledge of legal and court policies, procedures, practices, terminology and systems; state and federal laws, rules and regulations; and principles and practices of evidence collection

Education and Experience: This position requires a Juris Doctorate from an ABA accredited law school. Candidates must be eligible to sit for the Montana Bar Exam although current admission to the Montana Bar is preferred. Applicants should also have at least six years of practical experience in law, preferably in litigation of criminal and civil law, and five years of progressively responsible management and supervisory experience.
