Job Description
The Office of Legal Affairs is seeking an Associate Counsel to work in a dynamic environment as in-house counsel within NYC Health + Hospitals’ Supply Chain Services, the system’s centralized procurement department.

Supply Chain Services contracts for clinical goods and supplies, business, information and construction goods and services, software, pharmaceuticals, consultants, and staffing on an enterprise-wide basis for NYC Health + Hospitals’ eleven acute care hospitals, five post-acute care facilities and multiple ambulatory care centers. The annual spend for such goods and services is approximately $1.2 billion.

The attorney will be primarily responsible for reviewing, drafting, and negotiating the System’s information technology and construction-related contracts, ensuring that contracts meet all of the system’s legal, internal operating procedure, and operational obligations.

The attorney must have excellent inter-personal, writing, analytical, and problem-solving skills, be able to manage a high volume of contracts, and want to be a meaningful part of a mission-driven, large, integrated healthcare delivery system through the performance of legal transactional work.

The attorney should have specialized knowledge and experience with information technology contracts (such as SaaS agreements, software licenses, consulting contracts), as well as General Municipal Law 5-A.

The attorney must have the ability to work with other members of the Office of Legal Affairs and executive business leaders on matters specific to Supply Chain Services involving:
  • HIPAA, New York State labor laws, the New York City Health and Hospitals Corporation Act of 1969, CMS regulations, anti-kickback issues, FOIL, and vendor diversity requirements (e.g. NYS Executive Law Article 15-A).
  • Internal operating procedure requirements include ensuring that the proper manner and method of solicitation of contracts was performed, that vendors are responsible, and that all necessary internal approvals have been obtained.
  • Operational requirements, including ensuring that contracts are reviewed timely, are operationally achievable, and meet the business needs of the system.

The attorney might also assist in various legal research, contract negotiations, drafting of policy, assistance with audits and compliance, as well as project management and development of standard processes.

Minimum Qualifications
  • A baccalaureate degree or equivalent, and LLB or JD from an accredited School of Law; and admission to New York State Bar; and
  • Three (3) years of experience and background in the practice of law subsequent to admission to the Bar in matters of litigation, negligence, corporate law, contracts, real estate, labor relations, labor law and employee relations, or
  • Two (2) years of experience and background in the practice of law subsequent to admission to the Bar in matters of litigation, negligence, corporate law, contracts, real estate, labor relations, employment law and employee relations, with two (2) years of progressively responsible experience in a professional or managerial capacity in respective fields applicable to the general body of law, specialties or practice.
