What you will be doing:
The Associate Attorney will perform a wide variety of functions to support the Law Offices of Beth A. McDaniel, PLLC’s practice. The qualified candidate will prepare and consult with clients on a variety of matters, including guardianship and probate. He or she will be responsible for maintaining transactional and court-supervised caseloads, as well as, upholding and protecting the interests of our clients and their families. The Associate Attorney will provide excellent client service with attention, responsiveness, and commitment to understanding our clients’ end objectives.

Responsibilities:
  • Consult with clients on guardianships of minor children and incapacitated adults, probates, trust administrations, and matters, and consistently act in the best interest of our clients in accordance with the governing state and federal laws and the rules of professional conduct
  • Review and draft all court required filings prepared by paralegals, as well as draft pleadings, correspondence, and memorandums
  • Anticipate legal risks
  • Coordinate with paralegals to ensure that client fiduciaries meet their legal obligations
  • Ensure that agreements are implemented
  • Ensure final disbursements of assets to beneficiaries
  • Assist litigation co-counsel through mediation or trial
  • Negotiate on behalf of clients
  • Stay apprised of court and statutory deadlines
  • Stay up-to-date with all pertinent laws and legislation
  • Communicate with clients to commence an engagement, keep client matters moving forward in a timely manner, and ensure the firm’s support staff are in alignment with the clients’ needs
  • Support business development efforts, including but not limited to, meeting with prospective clients and evaluating their needs, as well as, participating in networking activities in order to build relationships with referral sources
  • Apply knowledge of the law, functions, strategies, and processes to provide services, solutions, and advice to the clients or firm serves
  • Develop and maintain excellent working relationships with clients to ensure retention and referrals
  • Track and post all billable and non-billable work
  • Develop and maintain a collaborative and supportive working relationship with all staff, legal and non-legal
  • Develop and model an understanding of the firm’s philosophy, values, culture, and infrastructure

Essential Requirements:
  • Have a minimum of 2 years of experience in probate, guardianship, long-term care planning, special needs planning, and trust administration
  • Have experience in both transactional and court-supervised matters
  • Have a thorough understanding of state and federal tax laws, trusts, wills, property, real estate, special needs, and elder laws
  • Have proficiency with ZolaSuite Practice Management Software or comparable practice management software a plus
  • Ensures high quality of work by taking full responsibility for all work-product assigned and or delegated, as well as all internal, external, and court deadlines
  • Have a strong understanding of financial matters and issues
  • Have a demonstrated ability to creatively solve complex problems
  • Have the ability to deliver exceptional hands-on client service
  • Have the ability to deliver honest and straight-forward communication
  • Have strong organizational, drafting, and analytical skills
  • Have confidence and self-motivation
  • Have compassion and patience for the elderly clients

  • Provide clear oral and written communication skills
  • Bachelor’s degree required
  • Juris Doctor (JD) degree required
