Purpose of Position:

Why does the job exist?
This position for the Public Education Department (PED), is responsible for numerous areas of state and federal law such as: ESSA, FERPA, federal Impact Aid law, Inspection of Public Records Act, Open Meetings Act, State Procurement Code, State Personnel Act, Per Diem & Mileage Act, Public School Code (e.g., laws related to statutory duties of the PED and PEC, bilingual education,
truancy, capital outlay, public school funding, school personnel, and Indian Education). Additionally, this position involves reviewing state contracts, civil litigation, and drafting/editing agency rules.

How does it get done?
  • Provides comprehensive legal services as assigned by the General Counsel and Deputy General Counsel. The legal services are comprehensive as determined to be necessary to carry out the functions of the Office of General Counsel. Provides advice to senior management and staff regarding complex legal and management issues. Advice is provided in the context of formal and
  • informal meetings, telephonic and electronic interactions, review of documents, and written memoranda. Performs legal research that is defensible and that supports advice given or opinions/advice stated in any number of legal documents, forms and letters. Prepares legal documents, including letters, litigation pleadings, reports, memoranda, Public Education Department rules and
  • related documents, responses to charges and complaints, joint powers agreements. Reviews responses made pursuant to the inspection of Public Records Act and review professional services and intergovernmental agreements.
  • Such tasks are generally to be accomplished through legal research, legal review of documents and other materials, discussion with PED staff, and in consultation with General Counsel or Deputy General Counsel. Employee is to inform the supervisor of new matters if they are brought to the attorney directly, communicate with supervisor about important issues that may have a larger
  • impact on the agency, and work in all tasks with a team building perspective for the Office of General Counsel, focusing on the department's interests. Employee is to brief Deputy General Counsel on final conclusions for requests and assignments when reached, to ascertain Office of General Counsel's final legal opinions and determinations regarding completing the assignments.

Who are the customers?
The attorney would provide legal services for the agency head or other employees as determined by the agency head. The position would report to the Deputy General Counsel for the Public Education Department.

Ideal Candidate:
The ideal candidate will have experience providing legal advise to agency managers.

Minimum Qualification:
Juris Doctorate degree from an accredited school of law and two (2) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Employment Requirements:
Must possess and maintain a valid New Mexico's Driver's License.
