The Virginia Office of the Attorney General is seeking a qualified attorney to join the Transportation Section of the Government Operations & Transactions Division. Duties: The Transportation Section represents and advises the state agencies, offices, authorities, and boards that report or are assigned to the Virginia Secretary of Transportation. The current vacancy is for an attorney who will be co-located in an office with the Virginia Department of Transportation (VDOT), and will have primary responsibility for representing VDOT on right of way legal issues and land acquisitions. Most of the work deals with right of way acquisitions, whether they be voluntary or by eminent domain. The work also involves the review and approval of closing transactions and related title work, and supervising multiple eminent domain cases assigned to outside counsel with issues involving land valuation, landowner access and relocation. This position will be assigned to the Southwest Virginia region, which includes the Bristol District, Salem District, Lynchburg District and Staunton District. The position is currently housed in VDOT’s office in Salem, but consideration will be given to other locations within the Districts. Core duties will include review and preparation of deeds, easements, and other estate documents as well as legal research and analysis; reviewing proposed settlements of eminent domain issues; and communicating directly with VDOT staff, engineers, and real estate appraisers. Some overnight travel may be required.
Qualifications: A minimum of five years of demonstrated experience in one or more of the following areas: (i) negotiating and drafting documents for and closing general real estate transactions and related matters (sales, purchases, leases and easements with right of way matters), (ii) familiarity with title, survey, and general real estate matters, and (iii) reviewing, drafting, and advising clients regarding eminent domain matters. Candidates should have a history of advising clients on real estate matters, with an emphasis on the ability to communicate well with all levels of understanding regarding legal issues. The candidate should have a familiarity with mineral rights issues. Candidates must have excellent written and oral communication skills and be able to work well within a small team of professionals. The ideal candidate will have more than ten years of relevant experience. Applicants must be admitted to, or eligible for admission to, the Virginia State Bar.
