The New York City Housing Authority (NYCHA) Law Department Safety and Security (Anti-Narcotics and Special Investigations) Unit conducts administrative termination of tenancy proceedings brought on such grounds as non-desirability, including: criminal conduct by members of a household or purported members of a household, including violence and drugs, breach of NYCHA rules and regulations, and violations of stipulations with NYCHA. Attorneys in this Division shall, with wide latitude for making independent decisions for a high volume of cases, draft charges, negotiate settlements and litigate termination of tenancy matters before an Impartial Hearing Officer on the following grounds: Non-Desirability, Breach of Rules and Regulations, Chronic Delinquency in the Payment of Rent, and Non-Verifiable Income. This is done to ensure that these cases are handled expeditiously and in accordance with all legal requirements set forth in the Escalera Consent Decree and all other laws pertaining to tenant litigation.

Responsibilities of the Agency Attorney will include, but are not limited to the following:
  • Quickly identify key issues in a case and gain a rapid resolution with a minimum of supervision and with wide latitude for independent judgment.
  • Prepare and litigate administrative hearings and grievances including: preparing charges, requesting investigations, negotiating settlements, and appearing at Hearings to represent NYCHA.
  • Answer inquiries from managers, the Hearing Office, opposing counsel and borough management on assigned cases.
  • Conduct legal research on complex cases and prepare legal memoranda.
  • Maintain computer records in the Case Management System and prepare memos and other documents regarding case dispositions.
  • Maintain all case files, evidence and computer files for large caseload. Prepare memos regarding progress of cases and case dispositions.
  • Represent NYCHA in Applicant Appeal actions.
  • Represent NYCHA in Small Claims Court actions.

Note: The selected candidate will be required to maintain confidentiality regarding all NYCHA proceedings.

Minimum Qual Requirements
  • Admission to the New York State Bar; and either "2" or "3" below.
  • One year of satisfactory United States legal experience subsequent to admission to any state bar; or
  • Six months of satisfactory service as an Agency Attorney Interne (30086).
  • Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.

In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Preferred Skills
  • Excellent verbal and written communication skills.
  • Litigation/Trial Experience.
  • Knowledge and background in Housing Law, HUD Regulations, Criminal Law and Criminal Procedure.
  • Ability to work Independently with minimal direction; self-starter.
  • Second language, Spanish preferable.
