An American Fast Casual Restaurant Chain Based in New York City is looking for an accomplished attorney to strengthen its Legal function and support the company in its growth plans, while ensuring ongoing risk management and compliance. This role will lead the employment law function at An American Fast Casual Restaurant Chain Based in New York City, providing counsel and advice in support of the company's operations. This senior attorney will be a key strategic advisor to People Resources and other business leaders, and serve as a critical link between the Shacks, People Resources and the Legal department.

This position will be based out of our NYC office on either a full time or hybrid (working from home 1-2 days per week) basis.

Responsibilities:
  • Manage all aspects of dispute resolution, pre-litigation investigations, and litigation, including assessing new employment related charges, complaints, and attorney demand letters; developing strategy to resolve them; engaging and supervising outside counsel as applicable; and providing clear, concise, and accurate guidance
  • Draft responses and position statements, respond to information requests, and participate in fact-finding conferences and mediations
  • Assist or lead internal investigations
  • Provide counsel and advice to management, Human Resources, Operations, and the Shacks on all employment related issues, including but not limited to wage & hour compliance, performance management, discipline and terminations, internal investigations, reasonable accommodations, leave of absence, work permits, and discrimination
  • Assist People Resources in developing and implementing policies, procedures and training programs to drive compliance with employment laws
  • Actively participate in a collaborative manner in cross-functional business teams to identify, evaluate, and resolve complex business issues and risks
  • Coordinate with Risk Management on insurance for litigation matters

Qualifications:
  • Broad subject matter expertise in federal and state employment laws and regulations
  • Excellent judgment, discretion, and risk assessment
  • Strong and effective drafting skills
  • Exceptional communication skills and the ability to establish and maintain effective relationships
  • Practical business acumen, driving pragmatic business-oriented solutions
  • A highly approachable, collegial, and collaborative approach

  • Superb organizational skills and the ability to manage and prioritize multiple projects at once

Experience:
  • 12-15+ years of related employment law experience
  • Must have law firm and in house experience
  • Retail or hospitality experience preferred
  • Experience in a fast-paced and dynamic organization preferred
  • Member in good standing of the New York Bar or another bar association with the ability to register as in-house counsel in New York
