Position Description: Responsible for providing legal counsel and representation of the Department in all phases of the acquisition of right-of-way for transportation facilities. Responsible for representation in all phases of eminent domain proceedings, including research, the preparation of pleadings, discovery, preparation of witnesses, hearings, settlement negotiations, and trial. Responsible for preparing real estate conveyance documents. Responsible for representation in defense of the Department in claims of inverse condemnation, as assigned.

Responsible for thoroughly researching all state and federal statutes, court cases, rules, and regulations affecting the right-of-way acquisition operations of the Department. Responsible for advising the right-of-way offices the attorney is assigned to work with of their legal powers and duties, how the law affects their operations, and the implementation of policies and rules.

Provides support to Department attorneys representing the Department in claims and litigation against and by the Department. Assists with responding to public records requests and subpoenas, as assigned.

Knowledge, Skills and Abilities: Knowledge of litigation and civil rules of procedure and practice and Government In the Sunshine Law. Knowledge of the principles and techniques of effective verbal and written communications. Ability to understand and apply applicable rules, regulations, policies, and procedures. Ability to utilize problem solving techniques. Ability to work independently. Ability to plan, organize, and coordinate work assignments. Ability to communicate effectively orally and in writing. Ability to establish and maintain effective working relationships with others. Ability to use word processing, graphic presentation software, database, and mainframe applications.

Required Licensure/Registration/Certification: Must be a member of The Florida Bar.

Other Job Related Requirements: This position requires overnight travel. This position requires a Level I background check.
