Job Description and Duties:
Experienced employment law attorney wanted for a full-time permanent position within A California State Agency Information, Personnel & Audits (IPA) Bureau. The IPA Bureau is one of three bureaus housed within the Legal Division's Information, Technology & Administrative Litigation (ITAL) Branch. The IPA and the Technology & Contracts Bureaus provide legal advice and representation across the entire Department. Subject matter areas include human resources, audits, privacy, public records, information technology, legal agreements (contracts, grants, etc.), and managing the Foster Family Home and Small Family Home (FSH) Insurance Fund. The Policy, Program, and Technology Branch provides administrative support to three of the five branches, including ITAL, within the Division. Although primarily working remotely, the Branch has maintained a collegial and collaborative environment.

Under the general direction of the Assistant Chief Counsel, the Personnel Attorney III performs sensitive and complex legal work consistently and with favorable results. This position has extensive interaction with clients providing both verbal and written legal advice as well as representation of A California State Agency management at all levels on a wide range of employment matters including personnel actions, decisions and policies; discrimination, harassment, and retaliation prevention and claims; whistleblower complaints; criminal background reviews; and conflict of interest. The Attorney III prepares and files pleadings, briefs and other legal documents related to disciplinary and other matters; represents the Department before the State Personnel Board, Office of Administrative Hearings, and other administrative bodies; and collaborates with the Office of the Attorney General and CalHR on Department legal matters.

  • be able to work under tight deadlines and pressure;
  • demonstrated ability and experience in managing multiple and varied legal matters simultaneously.

Working Conditions:
Travel, including overnight, may be required.

The Legal Division uses a hybrid telework model to provide all employees with an avenue to telework while ensuring business and operational needs are met.

The assigned office location for this position can be filled in the following counties, whichever has available space and is closest to the successful applicant's residence:
ALAMEDA, BUTTE, FRESNO, HUMBOLDT, LOS ANGELES, ORANGE, RIVERSIDE, SACRAMENTO, SAN DIEGO, SAN MATEO, SANTA BARBARA, SANTA CLARA, SONOMA.

Except when required to report to the office, this position allows for telework at an alternative work location. An alternative work location would be the successful applicant's residence. For travel purposes, reimbursement would be based on the assigned office location.

This position may be eligible for hybrid telework under California Government Code Section 14200 for eligible applicants residing in California. All telework schedules are subject to change and may be reevaluated at any time. Specific telework arrangements may be discussed in more detail with the respective hiring manager. Telework does not change the terms and conditions of employment, the essential functions of job duties, or required compliance with the Department of Social Services policies. Headquarter location will be designated based on the selected candidate's primary residence location, and/or the closest A California State Agency location.

Please Note: A Statement of Qualifications or Supplemental Questionnaire must be submitted along with your application in order to be considered for this position. Applicants must be current members of the California State Bar.

In addition to the STD. 678 job application, applicants must also submit a two-page maximum (12-point Arial font type, standard margins) STATEMENT OF QUALIFICATIONS (SOQ). The SOQ is a narrative discussion of how the applicant's education, training, experience, and skills meet the job description, desirable qualifications and duty statement for the position. The SOQ will also serve as documentation of your ability to present information clearly and concisely in writing, since this is a critical factor to successful job performance.

The SOQ should:
  • Describe your interest in public sector employment law,
  • Demonstrate your commitment to the mission of the A California State Agency,
  • Describe your experience in competently and successfully litigating administrative hearings,
  • Describe your house counsel experience in the public sector employment law arena.

A resume or cover letter in lieu of the SOQ responses will disqualify an applicant from consideration. A standard or generic SOQ will disqualify an applicant from consideration. Application packages received without the SOQ will not be considered.

Hiring is subject to state civil service Super SROA/Surplus policies and procedures.

Training and Development assignments may be considered based on the availability of eligible candidates and are subject to approval by the Hiring Authority prior to appointment. Training and Development assignments are considered limited term, 12 months, and may be extended up to 24 months or become permanent.

The selected candidate will be subject to a criminal record background check clearance by the Department of Justice and the Federal Bureau of Investigation. A criminal conviction in and of itself will not necessarily bar an offer of employment.
