Legal Director - Institute for Constitutional Advocacy and Protection (ICAP) - A Private Jesuit Research University

The mission of A Private Jesuit Research University Law's Institute for Constitutional Advocacy and Protection (ICAP) is to use the power of the courts to defend American constitutional rights and values. ICAP draws on expert litigators, novel litigation strategy, and the constitutional scholarship of A Private Jesuit Research University to vindicate individuals' rights and protect America's constitutional way of life.

Job Overview:
The ICAP Legal Director provides leadership, strategic development, and administrative management to support ICAP's overall operations – and meets their responsibilities by employing diverse litigation and policy experience, exceptional legal and writing abilities, and top-notch management skills.

In furtherance of ICAP's core activities, and in conjunction with ICAP's Executive Director and Supreme Court Director, the Legal Director guides ICAP's team of attorneys in identifying opportunities for, and then developing and executing, litigation and policy strategies in cases at all levels of the courts (state and federal; trial and appellate) and in government. Specifically, they:
  • Provide strategic direction regarding when litigation and/or policy development provides a promising mechanism for pursuing the defense of constitutional rights
  • Take a lead role in developing legal theories and policy strategies to meet both urgent and emerging needs
  • Oversee complex, fast-moving, high-impact litigation in defense of constitutional rights and values, from brainstorming through drafting and reviewing briefs and engaging in oral argument;
  • Build relationships with partner organizations and potential clients for litigation and policy initiatives
  • Teach (alongside the Executive Director and Supreme Court Director) ICAP's Constitutional Impact Litigation practicum-seminar each semester and ensure that A Private Jesuit Research University Law students are meaningfully and materially integrated into ICAP's litigation and policy efforts; and
  • Speak and write for non-attorney audiences to support ICAP's core goals

The ICAP Legal Director draws on their own litigation, policy, and management experience to help oversee ICAP's overall efforts, including supervising ICAP's attorneys, practicum students, and summer interns.

Requirements and Qualifications:
  • J.D.
  • Experience teaching and/or supervising students or supervising other attorneys - preference for at least 10 years of experience in legal work after law school, including federal court clerkships, experience in impact litigation, and/or legal policy experience
  • Demonstrated ability to develop and implement innovative litigation and/or policy strategies
  • Commitment to promoting a sense of belonging and contributing to an equitable and inclusive learning and working environment
