Job Summary:
As the General Counsel, you will provide legal advice to the Office of the Minnesota Secretary of State (OSS) as well as information to our county and municipal Election partners, Business Services partners, and the general public. This position serves as the subject matter expert on: data practices compliance; legislation review and rulemaking; advising on applicable federal and state statutes, case law, and administrative rules and practices. This position will work closely with the Deputy Secretary of State, OSS's division directors, and the Attorney General's office.

This position supervises 2-3 staff in the legal and official documents division.

Responsibilities include:
  • Provide legal analysis and advice with respect to the application of Minnesota statutes and rules to fact situations and hypothetical questions.
  • Provide on an agency wide basis, legal advice regarding OSS compliance with the Minnesota Government Data Practices Act and other applicable privacy laws.
  • Assist in executing all legal and regulatory aspects of rulemaking.
  • Provide legal review of legislation and assist in fiscal note coordination as required by the legislature.

Qualifications:
Minimum Qualifications:
  • Juris Doctorate (JD) degree from an ABA accredited law school.
  • Current license and in good standing to practice law in Minnesota
  • Four years or more of legal experience as a practicing attorney which must include conducting legal research, writing, and analysis in two or more of the following areas of law: Minnesota Data Practices laws, grantmaking law, business entity law, or election law.
    • Experience must include knowledge of the State's Legislative and Rulemaking processes.

Experience must demonstrate the following:
  • Strong legal research, analysis, and writing skills;
  • Building and maintaining good working relationships with internal and external stakeholders;
  • Providing legal advice to leadership on diverse and complex data privacy matters; and
  • Experience in one or more areas of law related to the position, namely, data privacy law, administrative law, grantmaking law, business entity law, or election law.

Preferred Qualifications:
  • Experience working in or with the Attorney General's Office and/or State government agencies.
  • One or more years of supervisory experience.
  • Experience providing legal advice and representation on the Minnesota Government Data Practices Act including the ability to analyze data, determine classification of data, and provide protection of not public data.
  • Variety of experiences working effectively with others from different backgrounds and cultures.
  • Expertise or experience handling complex issues related to state and federal data privacy and security.
