We are currently seeking a Employment & Litigation CounselEm to join our team in Herndon, Virginia (US-VA), United States (US).

This role provides advice and counsel to Human Resources professionals and business leaders on employment and labor law compliance, as well as advising on employment litigation matters and potential matters. The focus of the role will primarily be U.S. (federal and state) employment law matters. Depending on the candidate's skills and experience, responsibilities may eventually expand to cover more strategic responsibilities. This position reports to the Vice President, Employment & Litigation Counsel and is a hybrid position based in Herndon, Virginia.

The duties of the position include the following:
Employment Law Counseling and Advice:
  • Provide employment and labor law advice and counseling on a range of employment law issues (e.g., workplace investigations, performance management and discipline, terminations, reductions in force, leaves of absence and accommodation of disabilities, wage and hour issues, recruiting, federal contractor, Service Contract Act, and OFCCP compliance, and the use of subcontracted or contingent workers) to senior leadership team.
  • Assess and audit compliance requirements and legal risk under federal, state and local employment laws and regulations, and advise HR of new developments and requirements.
  • Work collaboratively with HR professionals to develop solutions to complex human resources issues that appropriately balance compliance concerns and business needs.
  • Develop, review, and periodically update HR policies.

Dispute Resolution and Litigation Management:
  • Manage and resolve employment disputes through negotiation and other mechanisms.
  • Represent the Company before administrative agencies.
  • Work with business leaders to set strategy and direction for ongoing matters.
  • Direct and manage outside counsel in employment and contract litigation.

Training:
Develop and conduct training for managers and HR professionals on topics involving employment law compliance and HR best practices.

Basic Qualifications:
  • Jurist Doctor (JD) Degree
  • Member in good standing of any U.S. state bar
  • At least 3 years minimum experience at a law firm in broad management-side employment law practice (in-house or law firm), including Title VII, ADEA, OWBPA, ADA, FLSA, FMLA, NLRA, WARN, OFCCP and other federal, state and local employment laws and regulations.
  • Employment litigation experience, including representation of clients before administrative agencies and state and federal courts.

Preferred Qualifications:
  • A combination of law firm and in-house experience is preferred.
  • Excellent analytical ability and professional judgment in employment law matters.
  • Excellent human resources problem solving skills; experience and skill in balancing business needs and potential compliance risks.
  • Judgment, objectivity, professionalism and integrity necessary to for addressing sensitive, confidential, complex personnel issues.
  • Ability to advise senior executives, business leaders and HR professionals.
  • Ability to collaborate with other members of the legal team, HR professionals, and business leaders on a broad range of matters, projects and initiatives.
  • Superior oral and written communication skills.
  • Excellent organizational skills; ability to manage and prioritize many tasks to deliver timely, high-quality work.
