Summary:
This position is responsible for all-level appellate and other post-conviction work for the criminal and civil units of the A Government Entity Prosecuting Attorney's Office. The position includes providing legal research assistance to criminal and civil trial attorneys, training attorneys and law enforcement officers, and other duties consistent with serving as a resource for the office.

DPA III Salary upon hire is $55.57 to $63.70 per hour (step 1 through 5) depending upon qualifications.

Sr. DPA Salary upon hire is $59.53 to $68.24 per hour (step 1 through 5) depending upon qualifications.

Progressive increases are based upon years of service with A Government Entity, up to step 10 (top step is $73.83/hr. for DPA III and $79.09 for Sr. DPA). The DPA III and Sr. DPA are Range 34 and 35 of the PA Guild Union salary schedule.

NOTE: The Prosecuting Attorney Guild is currently in labor negotiations (for 2024 - 2025) and these salaries are anticipated to increase upon contract ratification/approval.

Essential Functions:
  • Handle the prosecution of complex appeals at all levels of Washington State courts, to include ITA appeals, while demonstrating highly persuasive written and oral advocacy grounded in exemplary legal research.
  • Handle RALJ appeals.
  • Handle post-conviction proceedings such as petitions to restore firearms rights, petitions to remit LFOs, petitions to vacate convictions, petitions to be relieved of the duty to register as a sex offender.
  • Review requests for clemency, pardons, and for U-Visa and T-Visa certification.
  • Upon request, handle requests for resentencing based on Blake and/or other changes in the law.
  • Upon request, handle post-conviction proceedings in the trial court such as CrR 7.8 motions.
  • Provide sound legal research assistance to trial attorneys.
  • Train and advise attorneys, staff, and law enforcement on decisional authority, court rules, and statutes relevant to the practice of criminal law, including prosecutorial ethics.
  • Establish and maintain productive and positive working relationships with groups and individuals both inside and outside the office, including with fellow DPAs, advocates and support staff, defense counsel, judges, court staff and the Clerk's Office, victims and witnesses, law enforcement agencies, and members of the community at large.
  • Attend and participate in WAPA appellate committee online and in-person appellate discussions and meetings.
  • Understand that the principal duty of every deputy prosecutor is to seek justice and to exercise his or her discretion with that responsibility in mind.

Supervisory:
This position has no direct supervisory responsibilities. This position is supervised by the Chief Criminal Deputy Prosecutor.

Related duties as required are duties that may not be specifically listed in the position description, but are within the tenurial occupational series and responsibility level typically associated with the employee's classification of work.

Minimum Qualifications:
Law degree from an accredited law school. Member in good standing with the Washington State Bar Association.

At least five years of criminal appellate experience. May consider less appellate experience if the applicant has significant criminal trial experience and can demonstrate high quality research and writing skills.

Requires knowledge of:
  • A working familiarity with, and commitment to, the Rules of Professional Conduct;
  • Advanced knowledge of the Rules of Evidence;
  • Advanced knowledge of applicable Court Rules and judicial procedures;
  • Familiarity with office procedures, methods, and equipment use, including computers and applicable software.
