Department Overview: This office is responsible for the prosecution of criminal offenses committed within the County and for serving as the attorney for County government, including all agencies and boards. A County in Montana is dedicated to providing justice and service with excellence. Job Summary: The deputy county attorney I position works alongside the elected county attorney and other deputies, and together they are responsible for handling litigation and legal advice for the county. This position primarily works on misdemeanor offences and occasionally will be assigned felony offenses and/or civil issues. The attorney in this position will review reports and file appropriate charges or complaints on criminal offenses or civil violations. The deputy county attorney I will perform entry-level professional legal work on all facets of these matters to develop a thorough knowledge of the practice of law in the County Attorney's Office.

This position works primarily on felony offenses and/or on more complex civil issues. The attorney in this position will review reports and file appropriate charges or complaints on significant criminal offenses or civil issues. The deputy county attorney II will perform professional legal work on all facets of cases and will provide a high level of representation for the County Attorney's Office.

Essential Functions (Major Duties or Responsibilities): These duties are the essential functions and are not all-inclusive of all duties that the incumbent performs. Demonstrate a high degree of competency in ability to research and apply laws, court decisions, statutes, ordinances, and other legal authorities to prepare legally sound reports, opinions, briefs,and appeals.

Criminal Attorney I:
Review reports to identify appropriate offenses and evaluate the strength of cases. Follow-up factual investigation (i.e., interviews, gathering additional documentary evidence) and legaldiscovery will be conducted to prepare for hearings and trial. Appear and argue pre-trial motions and present criminal cases to the court or jury. This includes questioning potential jurors, presenting an opening statement, questioning and cross-examiningwitnesses, presenting closing arguments, and learning to manage a case in such a manner as toconvince the jury or court to decide in favor of the County.

Criminal Attorney II:
Review reports to identify appropriate offenses and evaluate the strength of cases involving significant felony offenses. Be well versed in factual investigation (i.e., interviews, gatheringadditional documentary evidence) and legal discovery to successfully prosecute all manner ofoffenses. Handle all manner of pre-trial motions and hearings and present complex criminal cases to a court or jury. Demonstrate a great competence in case management and trial presentation to obtainjustice on behalf of victims and A County in Montana.

Non-Essential Functions:
Attend workshops, seminars, and educational sessions to maintain continuing legal education. Serve as staff members on various committees to provide legal input and advice. Perform other duties as assigned, including but not limited to managing special projects, attending meetings and conferences, providing backup for other staff, presenting and training (officers,county officials and citizen groups), etc.

Physical Demands and Working Conditions:
Sitting for long periods of time. Standing, walking, bending, stooping, or kneeling. Use hands to operate computer hardware, calculators, keyboard, and other office equipment. Occasionally lift, carry, or move large binders or files of up to 20 pounds. Specific vision abilities required by this job include close and far vision, the ability to adjust focus while operating a computer and viewing into a monitor, to read paper documents, and to operate amotor vehicle.Personal mobility that permits the employee to serve the general public, access files and othermaterials in the office and in courts, and to operate a motor vehicle. The primary function of this job is not in a supervisory capacity. Clarity of speech and hearing which permits the employee to communicate well with others. Work for sustained periods of time maintaining concentrated attention to detail. Work is performed in an office and courtroom setting.

Knowledge, Skills, and Abilities:
The job requires a substantial knowledge of the concepts and theories of the legal profession, legal research and writing, trial procedure and technique, negotiating settlements and agreements, written and oral communications, including language mechanics, syntax and English composition, the principles and application of civil and criminal law, trial and hearing procedures and rules of evidence, and the statutory and constitutional laws of the State of Montana. The job requires a thorough understanding of county government operations and procedures.

The job requires skill in persuasion, advocacy, the use of office equipment, court procedures, research, oral presentations, leadership, communication, organization, time management, and written communication.

The job requires the ability to research, analyze and apply legal principles, facts, evidence and precedents to legal problems; prepare, present and conduct cases of law in court; present statements of law, fact and argument clearly and logically in written and oral form; develop and maintain effective relationships with other staff members, departmental representatives, county officials, members of advisory and policy-making bodies, the courts and the public; analyze and draft ordinances and regulations.

Education and Experience:
The job requires education and experience equivalent to graduation from college and an accredited law school, and membership of the Montana State Bar. This position requires a demonstrated ability to successfully litigate and try cases and effectively manage a heavy caseload or civil workload. Must be bondable.
