Job Summary:
Under the direction of the General Counsel or designee, serves as in-house counsel to the Promontory Conservancy and its board, committees, and staff. Work includes a variety of research and legal support functions in all areas of real estate, homeowners associations, including drafting rules, resolutions, and memoranda. Practice areas include civil litigation, contracts, state and federal constitutional law, local government law, real property and land use.

Examples of Typical Job Duties
  • Provide legal advice to the Promontory Conservancy, its board, committees, and staff on all matters the Conservancy undertakes.
  • Works semi-independently and applies professional judgment in the preparation of memoranda, resolutions, contracts, and correspondence. Requires complex problem solving and skillful legal strategy.
  • Respond to inquiries from realtors, title companies, contractors, surveyors, local government, etc., in connection with rules and regulations.
  • Assist in the representation of the Conservancy in claims as well as occasional civil litigation matters, including drafting and reviewing pleadings as well as working with outside counsel.
  • Attend Conservancy Board, and internal committee meetings as assigned.
  • Performs legal research and property, title, and tax research; responds to inquiries regarding association rules and regulations.
  • Prepare community newsletter with guidance from executive director. Handle communication regarding enforcement of ALL CCR's, By-Laws, Regulations, and Design Guidelines requirements and mandates.
  • Assist in maintenance of County related licenses, approvals, master plan compliance, CCR-related compliance, etc.
  • Assist in monitoring environmental-related studies (i.e., USU, wildlife, etc.) and work with governmental agencies as necessary regarding enhancements
  • Assist in the review and management of all contracts and reserve studies and budgets related to:
  • Snow removal, landscaping, asphalt, community enhancements, trails, signage, etc.
  • Assist with potential issues with owners, Board members, and Committee members regarding Developer v. Conservancy obligations, enhancements, etc.
  • May be assigned to any legal work Promontory Development from time to time.
  • Engages in development opportunities including continuing legal education training.
  • Other duties as assigned.

Knowledge, Skills, and Abilities:
  • Extensive knowledge of principles of civil law, preferably including real estate, title, contracts, community associations, and local government law
  • Ability to establish and maintain effective professional and working relationships with real estate service providers, other employees, community members, and the general public.
  • Ability to maintain confidentiality related to legal matters
  • Public relation and speaking skills
  • Ability to work well with others
  • Ability to effectively manage time
  • Proficiency in Microsoft Office applications, and other related software
  • Negotiation skill

Qualifications:
Education and/or Experience:
Required:
  • J.D. from accredited law school
  • Member in good standing of the Utah State Bar or the ability to obtain a Utah Bar license within six months of hire
  • One year of full-time employment in the practice of law
  • Ability to establish and maintain effective working relationships with Promontory staff in rapidly changing and complex legal and factual situations

Preferred:
Experience with home owner association and local government law
