About This Position:
The incumbent in this position litigates highly sensitive and high profile complex precedent cases in state and federal trial court, state and federal appellate court, federal court including federal bankruptcy court, and the Board of Tax Appeals with very little to no supervision from a higher-ranking attorney.

Duties include, but are not limited to:
  • Assists the agency in reviewing and submitting input regarding highly sensitive and high profile complex and precedent proposed and current legislation, which affects specific areas of tax.
  • Assists in researching laws, agency policies and interpretations of judicial decisions and providing legal advice on such to the Division Director and any other appropriate departmental personnel.
  • Performs administrative duties related to individual income; corporation income and franchise; sales and use; severance; natural gas franchise; excise; and legal administrative case inventories and special projects.
  • Participates with higher-ranking Attorneys to develop and conduct Department wide training on legal research, law or evidentiary matters.
  • Attends training courses to enhance legal skills and knowledge of advanced level tax laws, procedural and evidentiary laws, regulations, policies and procedures.
  • Performs other duties as assigned by the Legal and/or Executive Management Team.

Current permanent status classified state employees may be required to accept a Probational appointment if selected. If filled as a Job Appointment, there is a possibility that this position may be converted to a Probational Appointment should funding become available.

This position will be domiciled in East Baton Rouge Parish. Applicants must select this parish on their application to indicate that they are available to work in the parish of this vacancy.

A Tax and Natural Disaster Clearance will be conducted on all selected applicants to validate the timely submission of tax returns and payments. It is a requirement that all Revenue employees must adhere to all tax laws of the State of Louisiana.

LA R.S.15:587.5, 587.6 and the IRS require A Government Entity to conduct a criminal history records check of a prospective employee who will access federal tax information to perform job duties. Any applicant who receives and accepts a conditional offer of employment will require a completed criminal history records check prior to his or her first day of work.

Minimum Qualifications:
Possession of a license to practice law in the state of Louisiana.

Examples of Work:
Attorney:
  • Litigates routine cases in trial and appellate courts and before administrative tribunals under the supervision of a higher ranking attorney.
  • Assists an attorney of higher rank in preparing major or complex cases for trial by drafting pleadings, interviewing witnesses, writing legal memoranda and briefs.
  • Enters claims for collecting monies due the state.
  • Assists in preparing proposed legislation.
  • Drafts tentative rules and regulations and reviews rules, regulations, and bulletins prepared by administrative officers for conformity to the law.
  • Investigates reports of violations of statutes and administrative rules and regulations.
  • Prepares advisory opinions for review by a higher ranking attorney.
  • Prepares or reviews legal documents, including contracts, licenses, deeds, and abstracts.
  • Researches laws applicable to the above activities.
  • To conduct hearings and to render decisions.

Attorney--Administrative Law Judges/Referees:
Convenes Hearings that Are of A Routine Nature; Issues Subpoenas; Administers Oaths; Hears Testimony; Considers Evidence; Examines Witnesses; Maintains Order; Rules on Motions, Objections, Admissibility of Evidence and Procedure; Prepares and Issues Decisions and Orders Based upon All Evidence Gathered, Research of Pertinent Statutes, Pertinent Jurisprudence, and Independent Assessment of Acts Based on Credibility of Witnesses and Evidence.

Conducts Pre-Trial Conferences with The Attorneys to Resolve Preliminary Issues and Narrow the Scope of The Hearing to The Facts Actually in Dispute.

Determines if There Are Jurisdictional or Procedural Issues to Be Disposed of And if So, Decides the Most Appropriate Manner (i.E. a Limited Hearing, an Order to Brief the Issue, an Order to Amend the Pleadings, a Status Conference, Etc.) to Address These Issues.

Secures, Compiles, and Maintains All Records of Adjudications. Ensures that Accurate Records Are Maintained in The Proceedings that Evidence Is Properly Marked and Included in The Case Record, and That Audio Recordings Are Accurately Marked and Properly Indexed and Stores.

Conducts a Continuous Study of The Current Statues, Regulations and Case Law Related to Areas of Law for Which Hearings Are Assigned.
