Estate planning requires developing a good relationship with the client and understanding not only their financial situation and ensuring that their assets are protected but also ensuring their loved ones are protected and provided for so that they themselves can age with dignity.

Because we will also be entrusting you with the responsibility of representing our clients during an emotional, scary, and stressful time in their life our new associate must have experience preparing, investigating, and handling probate cases ranging from simple independent administrations with a will to dependent administrations. You need to know how to find your way around the courthouse; talk to the probate clerks, witnesses, attorneys as litem, staff attorneys and prepare the clients for hearings so that they are comfortable and assured.

Core responsibilities will include:
  • Set legal strategy, understanding clients' goals/desired outcomes and devising a strategy to advocate for their future and the future of their loved ones
  • Conducting (how many per week)client meetings, set client expectations, develop a relationship of trust and mutual respect
  • Meeting and at times exceeding billable requirements
  • Oversee the process and paralegals and/or legal assistants assigned to the matter
  • High-level legal research for new and novel issues
  • Draft and review court filings, applications and motions
  • Represent the client and advocate for them at hearings, conferences and family meetings
  • Resolve creditor claims for the estate
  • Assist executors and trustees with administration
  • Help clients consider their options and possible outcomes and choosing the best solution that would achieve the clients' objectives and create a sound asset protection plan for them based on their needs
  • Drafting and reviewing trusts, wills and ancillary documents
  • Develop and create asset protection strategies
  • Trust administrations

In addition to your skills, you need to have the right attitude. You need to be positive; this area of the law can be quite stressful and often it is an emotional time for our clients, and we don't need to create our own drama! You must be comfortable working in a team… we work together to achieve the best results for our clients. There are no “lone wolves” here. You need to be able to not only tolerate change and growth, but you should embrace it.
