The Role: Assistant General Counsel - Labor & Employment (Americas)

An American Publicly Traded Corporation is seeking a business-minded and self-motivated attorney. This attorney should have a track record that demonstrates a strong knowledge of the law, sound practical judgment, and the ability to succeed in a collaborative environment. Labor law and international employment law experience required. In this position, the successful candidate will interface with members of the company's management and People teams at An American Publicly Traded Corporation's offices in the Americas to manage and execute on a broad range of employment and labor matters. This reports to the Associate General Counsel for Labor & Employment, who reports to the Chief Corporate Counsel of S&P Global.

The Impact:
  • Serving as the subject matter expert in all areas of Americas labor and employment laws; ensuring compliance with all applicable employment practices laws, rules and regulations.
  • Providing strategic legal counsel and risk management advice to management and the People team on a wide variety of HR and employment practices matters, such as recruiting, compensation, performance management, separations, internal investigations, leaves of absence, discrimination, harassment, diversity and inclusion, workplace privacy, wage and hour compliance, restrictive covenants, reasonable accommodations, employee classification, immigration and general employment risk management.
  • Participate in efforts to prepare, implement and refine best-in-class labor- and employment-related practices, policies, guidelines, tools, programs and forms that align with the company's employee engagement strategy, values and business goals.
  • Representing and defending the company as necessary in employment disputes, including lawyer's letters and administrative charges. Manage outside counsel as necessary for employment litigation.

Responsibilities:
  • Liaising with the Head of Labor & Employment on employment matters in the Americas.
  • Preparing and conducting regular employee and management trainings on relevant matters, and managing company training programs in conjunction with the People team.
  • Monitoring and assessing the impact of legal and regulatory developments and enforcement trends at a country and local level.
  • Counseling management and the People team on new or pending legislation, laws, rules and regulations and industry developments and trends that affect the company and its operations.
  • Efficiently managing outside counsel with an eye toward minimizing outside counsel expense and meeting budget.
  • Review the existing labor compliance framework for each country in APAC & India - identify gaps and actions required. Partner with the People team & compliance partners (if any) to ensure risk free business operations.
  • Advise the People team on applicable statutory changes &/or implications related to our wellbeing/benefits programs (existing or new).

What We're Looking For:
Basic Qualifications:
  • 7+ years of relevant experience gained at law firm and/or in-house (ideally at a publicly-traded company).
  • JD or LLM from an accredited law school and maintains active bar membership in the United States.
  • Candidate must have exceptional business judgment, legal issue identification and problem-solving skills.
  • Requires a practical, business-oriented approach to problem-solving; candidate must be able to effectively counsel internal clients by providing them with clear, concise and commercial advice, and creative solutions where necessary, on established timelines to meet their business needs.

Preferred Qualifications:
  • Candidate must bring a positive, “can do” attitude to the workplace and works collaboratively with other members of the Legal team and with internal clients, integrity is a must.
  • Significant advisory experience.
  • JD with exceptional academic credentials.
  • Successful track record of in-house or similar advisory experience.
  • An American Publicly Traded Corporation states that the anticipated base salary range for this position is $143,000.00-$251,500.00. Base salary ranges may vary by geographic location. In addition to base compensation, this role is eligible for an annual incentive plan.
