What We Are Looking For: We are looking for someone who wants to grow with our organization and be a part of a team. The Assistant Counsel, Operations will be the first point of contact for our pharmacy teams in multiple locations across the country and will provide legal guidance and business advice across the broad range of topics facing the company, including the areas of healthcare compliance, contracts, employment, business insurance, risk management, real estate, and litigation.

This position requires the ability to collaborate and work effectively with others in a variety of settings. The successful candidate will be a self-starter with strong analytical and problem-solving skills, who is team-oriented and eager to make an impact on the day-to-day operations of a growing organization.

The Role:
The Assistant Counsel, Operations will interact with and provide legal counsel and practical advice directly to the local pharmacy management. Although reporting to the Associate Counsel, the Assistant Counsel, Operations will collaborate with all members of the legal department.

Day-to-Day Legal Compliance:
  • Provide legal counsel to local pharmacy leadership on key substantive areas affecting the company, including HIPAA, FWA, and healthcare compliance.
  • Assist with compliance initiatives, including monitoring pharmacy compliance with policies and procedures.
  • Assist in the development and implementation of legal strategies to support the Company's key business objectives.
  • Assist with legal and regulatory requests, including responses to subpoenas and other requests for information.

Contract Review and Negotiation
  • Draft, review, and negotiate customer-facing agreements including pharmacy product and service agreements, master service agreements, term sheets, business associate agreements (BAAs), and confidentiality agreements.
  • Support local pharmacy presidents and sales team members on all aspects of customer contracting, including key contract provisions, and pricing requirements and work with sales and marketing to ensure local teams execute a consistent and cohesive national sales approach.
  • Review and negotiate vendor and supplier agreements to ensure compliant, consistent, and cost-effective terms for the pharmacies.
  • Manage contracts from inception through renewal, amendment, and termination, while handling large contract volume.
  • Litigation and Risk Management:
  • Provide legal guidance to Human Resources and pharmacy management on day-to-day employment issues and employment-related agreements.
  • Manage all pre-litigation collections efforts, including investigations and drafting of collection-related correspondence and legal documents.
  • Under supervision of the Associate Counsel, assist with litigation matters affecting the pharmacies, including coordination with insurance brokers and outside counsel.

Education:
JD and license to practice law in Georgia.

Knowledge, Skills, and Abilities:
  • At least 2-5 years of relevant professional experience in-house or as outside counsel, advising corporations in contracting and compliance matters.
  • Experience working directly for, or advising as outside counsel to, pharmacies, pharmaceutical manufactures or suppliers, other healthcare providers is highly desirable.
  • Strong analytical skills, attention to detail, excellent communication and negotiation skills, and the ability to adapt to changing priorities.
  • Excellent written/verbal communication and interpersonal skills, including strong contract negotiation and drafting abilities.
  • Ability to work independently and deliver to deadlines.
  • Ability to solve problems with minimal direction.
  • Proficiency in Microsoft Office products.
